Cara Pengawasan Komisi Yudisial – hakim membutuhkan rambu- rambu dalam menjalankan tugasnya. Salah satu koridor ini adalah kode etik dan pedoman perilaku Hakim yang berdasarkan pada Surat Keputusan Bersama (SKB)
NONGKI.NET – Komisi Yudisial memberi pernyataan bahwa perbuatan Merendahkan kehormatan hakim masih sering terjadi. Anggota KY Kadafi memberi pernyataan bahwa dari periode 2019 hingga April 2012 1 kaya telah menangani 1988 atau informasi yang dianggap merendahkan kehormatan dan keluhuran martabat hakim.
Komisi Yudisial merupakan lembaga negara produk reformasi yang dibentuk dalam kerangka pelaksanaan reformasi bidang hukum, khususnya reformasi peradilan. Kedudukannya dalam struktur ketatanegaraan adalah setara dengan delapan lembaga negara lain yaitu; MPR, Presiden, DPR, DPD, MA, MK, dan BP K yang memperoleh atribusi kewenangannya langsung dari konstitusi. Keberadaan Komisi Yudisial sebagai lembaga negara yang bersifat penunjang (auxiliary organ) terhadap kekuasaan kehakiman, berdasarkan UUD NRI 1945 Komisi Yudisial mempunyai kedudukan sederajat dengan lembaga negara yang lain seperti presiden, DPR, dan lembaga negara yang lain. Komisi Yudisial bukan merupakan pelaku kekuasaan kehakiman, tetapi kewenangan yang berhubungan dengan kekuasaan kehakiman. Sejak awal berdiri, Komisi Yudisial telah menetapkan garis Kebijakan yang menempatkan civil society sebagai mitra strategis.
Dalam kerangka ini Komisi Yudisial menyadari betul bahwa upaya mensosialisasikan Kode Etik dan Pedoman Perilaku Hakim (KEPPH) kepada kalangan hakim tak akan bisa dilakukan tanpa memperkuat sistem di internal. Dalam kaitan itu, Komisi Yudisial melakukan penataan mekanisme pengaduan. Verifikasi atas pengaduan masyarakat merupakan langkah yang selalu ditempuh Komisi Yudisial. Kewenangan pengawasan hakim yang dimiliki Komisi Yudisial bertujuan untuk memperkuat akuntabilitas dunia peradilan. Kewenangan tersebut tercantum dalam Undang-Undang Nomor 48 Tahun 2009, tentang Kekuasaan Kehakiman dan khususnya Undang-Undang Nomor 18 Tahun 2011, pasal 20A ayat (1) point d yang berbunyi: Dalam melaksanakan tugas, Komisi Yudisial wajib menjaga kemandirian dan kebebasan hakim dalam memeriksa, mengadili, dan memutus perkara.
Undang-Undang mengamanatkan bahwa Komisi Yudisial merupakan pengawas eksternal perilaku hakim berpedoman pada Kode Etik dan Pedoman Perilaku Hakim yang disusun bersama oleh Komisi Yudisial dan Mahkamah Agung. Faktanya bahwa sebagian besar laporan masyarakat yang disampaikan kepada Komisi Yudisial menyangkut perilaku hakim dalam mengadili dan/atau memutus/menetspksn putusan, sehingga tidak bisa terhindarkan dalam memeriksa laporan masyarakat, Komisi Yudisial harus membaca putusan sebagai pintu masuk dan/atau bukti terjadi atau tidaknya pelanggaran kode etik dan pedoman perilaku hakim. Komisi Yudisial dalam melakukan pemeriksaan laporan masyarakat, berpedoman pada 10 butir perilaku utama sebagaimana dimaksud dalam Kode Etik dan Perilaku Hakim. Komisi Yudisial Republik Indonesia adalah Lembaga Negara yang diorientasikan untuk membangun sistem checks and balances dalam sistem kekuasaan kehakiman. Melihat kewenangan yang dimiliki, Komisi Yudisial merupakan organisasi publik yang dituntut bisa menjalankan aktivitasnya secara fleksibel dan mudah dikembangkan sejalan dengan perkembangan situasi eksternal.
Penguatan kewenangan pengawasan perilaku hakim dalam Undang-Undang dijabarkan dalam Pasal 20 Undang-Undang Nomor 18 Tahun 2011 yang menyebutkan bahwa untuk menjaga dan menegakkan kehormatan, keluhuran martabat, serta perilaku hakim dijabarkan beberapa tugas Komisi Yudisial. Ketentuan Pasal 20 ayat (1) Undang-Undang revisi ini secara akumulatif menentukan bahwa tugas Komisi Yudisial rangka menjaga dan menegakkan kehormatan, keluhuran martabat, serta perilaku hakim, adalah sebagai berikut:
- melakukan pemantauan dan pengawasan terhadap perilaku hakim.
- menerima laporan dari masyarakat berkaitan dengan pelanggaran Kode Etik dan/atau Pedoman Perilaku Hakim.
- melakukan verifikasi, klarifikasi, dan investigasi terhadap laporan dugaan pelanggaran Kode Etik dan/atau Pedoman Perilaku Hakim secara tertutup.
- memutus benar tidaknya laporan dugaan pelanggaran KEPPH.
- mengambil langkah hukum dan/atau langkah lain terhadap orang perseorangan, kelompok orang atau badan hukum yang merendahkan kehormatan dan keluhuran martabat hakim.18 Pengawasan yang dilakukan oleh Komisi Yudisial seperti diatur dalam undangundang revisi ini, merupakan upaya untuk mengatasi perilaku menyimpang hakim agar para hakim menjunjung tinggi kehormatan, keluhuran martabat, serta perilaku hakim. Oleh karena itu, apabila fungsi pengawasan oleh Komisi Yudisial itu berjalan efektif tentu dapat mendorong terbangunnya komitmen dan integritas para hakim untuk senantiasa menjalankan wewenang dan tugasnya sebagai pelaksana utama kekuasaan kehakiman sesuai dengan Undang-Undang serta kode etik dan pedoman perilaku hakim.
Maka kami menyimpulkan Kode etik tidak hanya berfungsi sebagai komitmen dan pedoman moral dari para pengemban profesi hukum ataupun hanya sebagai mekanisme yang dapat menjamin kelangsungan hidup profesi di dalam masyarakat. Pada intinya kode etik berfungsi sebagai alat perjuangan untuk menjawab persoalan-persoalan hukum yang ada di dalam masyarakat.
Untuk itu, hakim membutuhkan rambu- rambu dalam menjalankan tugasnya. Salah satu koridor ini adalah kode etik dan pedoman perilaku Hakim yang berdasarkan pada Surat Keputusan Bersama (SKB) antara Komisi Yudisial dan Mahkamah Agung. Memahami pentingnya profesi hakim dalam penegakan hukum dan keadilan, cara pengawasan Komisi Yudisial sebagai lembaga pengawas eksternal, berfokus pada pengawasan tingkah laku dan perbuatan hakim untuk menjunjung tinggi kehormatan, keluhuran martabat, serta perilaku dalam melaksanakan tugas dan wewenangnya sebagai penyelenggara kekuasaan kehakiman (peradilan).
