Ringkasan
Pada buku tersebut menjelaskan tentang dinamika yang terjadi mengenai konflik masyarakat dengan Perusahaan Sawit di Indonesia, buku ini menghasilkan telaah tentang cara komunikasi memprotes perusahaan kelapa sawit, mulai dari alasan mereka memprotes, serta sejauh mana mereka berhasil memperoleh solusi atas tuntutannya. Tiga pokok argumen yang dapat diambil kesimpulan dari buku ini adalah:
Pertama konflik yang terjadi antara masyarakat dan perusahaan sawit di Indonesia disebabkan oleh tidak adanya hak kompensasi yang didapatkan oleh masyarakat, hal tersebut dinyatakat sebagai sebuah pelanggaran dikarenakan adanya Undang-Undang atau regulasi yang mengatur tentang adanya sistem bagi hasil antara masyarakat dan perusahaan. Berbagai pertauran hitam diatas putih telah mengatur terkait perusahaan yang akan memasukkan tanahnya dalam perkbunan atau tanah masyarakat. Kedua, strategi masyarakat yang digunakan untuk merespon konflik adalah berfokus untuk mendapatkan kompensasi financial, ketimbang dengan hukum untuk perusahaan. Protes yang digunakan masyarakat lebih pada protes yang bersifat akomodatif, negosiasi serta dengan wacana yang diselimuti oleh norma sosial dan adat yang berlaku. Ketiga, mekanisme resolusi konflik yang tidak berjalan efektif, dibuktikan dengan konflik yang tidak bisa diselesaikan, beberapa contoh konflik yang sudah terjadi dan tidak selesai rata-rata menghabiskan waktu selama sebelas tahun, penulis juga mengemukakan bahwa resolusi konflik RSPO jarang sekali digunakan dalam konflik ini.
Dalam buku ini digambarkan adanya kontradiksi antara de jure dan de facto. Ketidaksesuaian antara regulasi dan yang terjadi dilapangan, 19 % perkebunan sawit dibangun dengan tidak sah di dalam hutan, perusahan banyak beroperasi tanpa izin, 99 kasus tidak memperoleh persetujuan, dan 67 perusahaan dinyatakan melanggar karena tidak membayar kompensasi, 86 perusahaan tidak memberikan kebun plasma sebagaiman yang diperintahkan dalam Undang-Undang, selain itu juga terjadinya tindak kekerasan dan intimidasi pada masyarakat yang berani melakukan protes pada perusahaan.
Tiga sumber kehampaan hak yang dijelaskan dalam buku ini adalah, Pertama karena hak tanah itu sendiri yang terbatas, masih mengandalkan pada warisan kolonial. Kedua mengenai perlindungan hukum yang dirusak oleh pihak-pihak yang sudah kompromi dengan perusahaan, Ketiga tentang hukum yang diperlemah oleh elit karena adanya bisnis antara negara dan perusahana kelapa sawit. Ketiga poin ini dikuatkan dengan adanya perseteruan politik perusahaan yang dijalin dengan beberapa pemerintah daerah setempat, yang nantinya menjadi tameng bagi perusahan itu sendiri, dikarenakan masyarakat tentu akan melakukan protes kepada pemerintah setempat terlebuh dahulu atas konflik ini, yang mana hal tersebut sangat menguntungkan dan melindungi nama baik perusahaan.
Penulis juga menjelaskan tentang apa yang dapat dilakukan untuk merespon konflik ini, antara lain adalah dengan mendirikan badan mediasi tingkat Provinsi dan Kabupaten, melakukan transparansi tentang izin HGU yang diberikan kepada perusahaan perkebunan, melakukan monitoring apakah perusahaan telah melakukan kewajibannya, pemeritah pusat maupun daerah harus menginvestigasi masalah kebun plasma, dan harus menjatuhkan sanksi kepada perusahaan yang melanggar peraturan.
Respon dan Analisis
Buku yang sangat menarik dibahas karena mengandung nilai kemanusiaan dan nilai sosial yang tinggi, buku ini mencontohkan tentang bagaimana hukum dapat dipermainkan oleh mereka yang mempunyai kekuasaan di negeri ini. Menggambarkan tentang bagiamana kelompok kecil yang tidak memiliki kuasa melawan mereka yang mempunyai uang dan kepentingan atas dirinya sendiri. Kasus perusahaan dan masyarakat kerap kali terjadi di Indonesia, rakyat kecil harus banyak menanggung resiko yang tinggi hingga kematian untuk mengisi kantong-kantong para pemilik modal dengan rupiah yang diambil dari hak masyarakat kecil.
Perwujudan dari penyempitan ruang kontestasi di buku ini sangat terlihat, bagaimana bangsa yang tidak memiliki kuasa melawan mereka yang berkuasa. Kekerasan, intimidasi seolah berjalan dan dinormalisasi begitu saja oleh mereka yang mengaku sebagi pejabat dan pelayan rakyat. Hak informasi atas data publik seperti HGU juga tidak pernah didapatkan oleh mereka yang terdampak adanya perusahaan sawit tersebut. Banyak yang perlu dipertanyakan dalam kasus ini, sepertihalnya bagaiman peran pemerintah daerah yang seharusnya ikut melindungi rakyatnya, bukan malah ikut mengambil keuntungan dengan mengorbankan hak mayarakat lainnya.
Permasalahan HAM di Indonesia telah ada sejak sebelum masa orde baru, penjajahan terhadap bangsa sendiri sampai hari ini masih sering dinormalisasi, yang kaya semakin kaya yang miskin semakin miskin. Pola itulah yang menjadikan Indonesia tertinggal jauh untuk menjadi negara yang maju. Peraturan yang sangat sakral seperti Undang-Undang digambarkan seolah tidak memiliki harga diri karena dapat dengan mudahnya dibeli oleh mereka yang memiliki materi.
Dalam kasus ini seharusnya menjadi kritik untuk perusahaan dan juga negara tentang penerapan economic inclusion sebagaimana yang diusung dalam World Economic Forum (WEF), adalah pembangunan ekonomi yang dapat menciptakan akses serta kesempatan yang luas bagi seluruh lapisan masyarakat secar adil. Konflik yang cukup besar dan berkepanjangan tentu menjadi topik yang banyak diperbincangkan pada wilayah tersebut, peran Universitas atau komuitas akademik juga perlu dipertanyakan dalam kasus ini bagaimana mereka merespon dan sikap seperti apa yang diberikan.
Beberapa konflik yang terjadi antara masyarakat dan perusahaan sawit merupakan implikasi dari Omnibuslaw Undang-Undang Cipta Kerja tentang perkebunan, beberapa pasal yang dirubah maupun dihapuskan memiliki dampak negatif diantaranya adalah pada UU No.39 tahun 2014 pasal 39 yang berbunyi pelaku usaha: dalam negeri dan PMA, kemudian pada UU Ciptakerja dihilangkan sebutan tersebut, yang mana memunculkan indikasi atau upaya untuk menghilangkan istilah PMA. Selanjutnya pada pasal 40 tentang pengalihan kepemilikan kepada PMA harus melihat situasi kepentingan Nasional, itu dihapuskan sehingga menimbulkan asumsi bahwa UU Ciptakerja pro kepada Asing. Kemudian pada pasal 45 ayat 1 yang membahas tentang izin usaha yang harus mendapatkan izin dari RT/RW dihapuskan, yang secara tidak langsung dapat menimbulkan adanya potensi pelanggaran dan eksploitasi lingkungan. Serta pada pasal 58 ayat 1 perusahaan dengan perizinan usaha wajib membangun kebun masyarakat minimal 20 % dari total luas tanah yang dikelola, dirubah menjadi “Disebutkan areal tersebut terdiri dari: areal lain diluar HGU dan pelepasan kawasan hutan, implikasinya adalah pelepasan kawasan hutan disini lebih diakui sehingga berpotensi meningkatkan konversi kawasan hutan ke perkebunan, dan masih banyak lagi pasal-pasal yang berimplikasi negatif pada masyarakat.
Ketimpangan sangat terlihat pada kasus ini, dimana skema kebun plasma tidak dilaksanakan sama sekali oleh perusahaan, dan tidak adanya sanksi yang diberikan oleh pemerintah setempat maupun pemerintah pusat. Sehingga pada titik ini menjadi faham kenapa buku ini dinamakan “Kehampaan Hak” karena hak mereka (maysarakat terdampak) ada namun tidak ada isinya (hampa).
Namun dari argumen penulis tentang istilah “Kehampaan Hak” justru menimbulkan pertanyaan baru yaitu mengenai sebenarnya hak atas apa yang dimaksud oleh penulis dalam buku ini? Apakah hak atas penguasaan lahan, atau hak atas hak guna lahan. Karena jika berbicara mengenai hak penguasaan lahan, maka ketika HGU sudah dimunculkan maka permasalahan akan selesai, namun ketika membicarakan tentang hak guna usaha, apakah dapat dijamin para masyarakat bisa mendapatkan ruang untuk melakukan negosiasi tentang hak guna usaha tersebut.
Kemudian selanjutnya penulis juga tidak mengemukakan argumen tentang bagimana peran dari kampus sekitar dalam merespon konflik tersebut bagaimana keberpihakannya, hingga sampai bagaimana para akademisi mengkaji konflik tersebut agar menghasilkan solusi yang bisa ditawarkan untuk masyarakat. Karena jika disimpulkan dalam buku ini hanya menjelaskan tentang bagimana konflik antara perusahaan dengan masyarakat, respon masyarakat yang berfokus dalam mendapatkan kompensasi finansial, serta mengenai resolusi konflik yang tidak berjalan sehingga menimbulkan berbagai intimidasi dan kekerasan.
Selanjutnya mengenai rekomendasi dari penulis tentang apa saja yang dapat dilakukan dari konflik yang terjadi diantaranya adalah mendirikan badan mediasi tingkat Provinsi dan Kabupaten, transparansi tentang izin HGU, monitoring terhadap perusahaan apakah sudah memenuhi kewajibannya, kemudian tuntutan kepada pemerintah yang harus menginvestigasi masalah kebun plasma, serta pemerintah harus menjatuhkan sanksi kepada perusahaan yang melanggar. Satu hal yang luput dari rekomendasi penulis adalah tentang Penyuluhan Hukum kepada masyarakat, yang akan membahas betapa pentingnya aspek ruang dan hukum dalam kehidupan manusia, aspek ruang berkaitan dengan segala kegiatan manusia yang ada diatas maupun dibawahnya contohnya seperti fungsi tanah untuk tempat bermukim, dan aspek hukum adalah aspek yang berkaitan dengan hak warga negara untuk memiliki dan menggunakan tanah tersebut sebagai tempat mata pencaharian (Guntur, 2014). Hal tersebut adalah hal yang paling mendasar bagi masyarakat terdampak, dikarenakan mayoritas mereka berasal dari penduduk yang minim pengetahuan tentang hukum pertanahan sehingga seringkali masyarakat hanya mengandalkan norma lokal dan nilai adat dalam menghadapi konflik lahan dengan perusahaan.
